TERMS + CONDITIONS

A little vocabulary for clarity

  • A ‘booking’ is when your request to book has been lodged and accepted by us, the owners of Brinsop Treehouses.

  • A ‘cautionary deposit’ is a deposit paid to cover damage or loss of content or excessive or incorrect use of the facilities.

  • 'Check-in time' the date and time when the Property will be made available to you.

  • 'Check-out time' the date and time when the Property should be vacated by you as set out in the Booking.

  • 'Holiday' the period of time when the Owner provides the Property to you as set out in the Booking.

  • 'Owner' the owner of the Property (or their representative).

  • 'Party List' the list of people including you and is limited to the maximum number of 4 adults/ children and 2 babies (under age 3), plus a maximum of 2 pets.

  • ‘Reference number’ relates to the number on your booking supplied at the time of booking. Please use or have this number handy in all communications with us. Bookings made via telephone will; be followed up with details and a reference number.

Bookings and payments

  • We reserve the right to cancel a booking, with a full refund, up to and including the booking dates at our discretion.

  • We require a party list at the time of booking. Any amendments to your party list need to be made in writing via our contact form.

  • You agree to arrive on or after the check-in time of 2PM and to leave on or before the check-out time of 10AM.

  • We reserve the right to use your cautionary deposit towards costs incurred due to late departures.

  • Bookings can be made by over 18s only.

  • Full payments, and deadline dates for payments, will always be detailed to you prior to your booking.

  • Payments can be made by debit card, credit card or bank transfer.

  • Bank transfers must be in cleared funds by the deadlines for payment and in GDP. Any bank or transfer charges are the responsibility of the guest.

  • VAT, if present, will always be included in the total cost and detailed.

  • Failure to pay any sums owed before the payment deadline will result in cancellation of your booking.

  • Any sum outstanding at the time of check-in will mean the guest has zero access to the property.

Deposits and payments

  • A 50% booking deposit is due at the time of booking. This secures your booking for you.

  • Full payment is due 28 days prior to your booking. Failure to pay the balance on your account before this time will likely result in your booking being released and your deposit being retained.

  • A reminder email will be sent out at this time to remind you of payment outstanding for the remainder of your booking.

Cancellations

  • You have a right to cancel.

  • Fully refundable cancellations can be made up to 8 weeks before your booking date check-in time.

  • Cancellations made less than 8 weeks to your booking will retain your deposit should we be unable to secure a rebooking. See ‘Refunds’ below re. reimbursements should your booking be resold.

  • Requests to amend booking dates will be accepted only up to 8 weeks of your arrival date, to insure us against loss of marketing efforts. (Amending a booking date represents a cancellation to us as all previous marketing efforts are lost.) Beyond this time, we will retain the deposit to cover our costs. See ‘Refunds’ below re. reimbursements should your booking be resold.

  • Cancellations made within 7 days of your booking will retain all funds taken should we be unable to secure a rebooking.

  • A cancellation is only accepted when a request has been written by email or via the contact form on the website and confirmed in writing by reply from the owners.

  • Failure to arrive for your booking is treated as a cancellation with zero reimbursement.

  • The owners retain a right to cancel your booking, up to and during your booking due to events outside of their control such as fire, flood, failure of utilities or any health and safety concern. In this instance a full refund will be made immediately.

Refunds

  • If we resell your full booking by the time of the original booking we will refund you your full booking amount, minus a £30 cancellation charge.

  • If we resell part of your booking we will refund you the partial amount, minus a £30 cancellation charge and provide proof of the replacement booking.

  • If your dates are not rebooked before the original booking date the full deposit and any additional funds will be retained, except in extenuating circumstances, which we politely ask for supporting evidence of.

  • Cautionary deposits will always be refunded in full in case of cancellation and acceptance by the owner.

General care and consideration for the owners’ property

  • During your booking, you and your party agree to take proper care of the exterior and interior of our property.

  • The maximum number of guests permitted is 4 adults/ children, 2 under 3 year olds and 2 pets. The property cannot comfortably withstand any more capacity.

  • No one other than the individuals listed in the Party List may attend the booking.

  • The Party List must detail any pets included in the booking.

  • The use of The Quist is for domestic and private bookings. Use of The Quist for commercial reasons must be notified to the owners prior to booking and is subject to their approval.

  • Strictly no smoking permitted inside the property. A stub bin is provided on the property deck.

  • The outside deck is accessible by the bifolding doors and protected by a wooden balustrade. We ask all guests to take special care when approaching the balustrade, especially of children and pets. This balustrade is safe during fair and normal use, but could be dangerous if used improperly. The owners take no responsibility for death or injury if used improperly. Please take care.

  • The hot-tub is to be used at guest’s own risk. It uses an integrated wood-burning stove to heat the water. We warn guests to never, NEVER empty the water while the fire is lit in the stove, under any circumstances; this is a serious fire risk. Please note that we add a small amount of chlorine to the water to sanitise before each booking. We ask guests to use the hot-tub in a sensible manner; to take care with the stove and be mindful of the input where the heated water is pumped in. We have provided all available safety accessories and the hot -tub is of premium industry quality and suitable for use in Scandinavian countries. Some guests may struggle with getting our hot-tub up to a pleasant temperature; please be assured that this is a top of the range item and designed to be used in very cold temperatures. We don’t mean to be cheeky, but if you can’t get the hot-tub water hot… it’s not the tool its the workman.

  • A fully stocked first aid kit is provided and found on the kitchen shelf, near to the fire extinguisher. Upstairs a fire blanket is provided and a large opening window exits to the flat roof.

Pets

  • If you are planning on bringing a pet that is not a dog, please notify us beforehand.

  • Pets are not permitted in the bedrooms or on furniture.

  • Please do not leave your pets in the property unsupervised.

  • Brinsop Court Estate is a working farm with livestock, arable farming and machinery present at all times. We cannot be held responsible for the safety of your pets.

  • We ask that you please provide your pet with suitable provisions and bedding.

  • In the interests of health, safety and hygiene, pets must be cleaned up after on the estate and inside the property without fail.

Liability

  • We, the owners have limited liability for death or personal injury caused by our negligence.

  • We, the owners have limited liability for fraud or fraudulent misrepresentation.

  • We, the owners have limited liability for a breach of the terms implied by the Consumer Rights Act of 2015.

Personal information

  • We will only communicate with you with marketing information if you have permitted us to.

  • We will only use your personal information as set out in our privacy policy.

Final notes

  • We strongly advise that all guests take out comprehensive holiday insurance to cover cancellation costs and your stay in the Property. If you choose not to then you accept responsibility for any loss that you may incur.
